Please read them before using our services or placing an order.

3. Using our websites
You agree to use our websites and services lawfully and responsibly.
You must not:
- Attempt to access accounts, galleries or information without authorisation.
- Circumvent passwords, authentication or other security measures.
- Use automated tools to extract or download content without permission.
- Interfere with the operation, security or availability of our services.
- Upload malicious, unlawful or infringing material.
- Misrepresent your identity or authority to access or order content.
- Use photographs, films or other protected content beyond the permissions granted to you.
We may restrict access where reasonably necessary to protect our services, users or legal rights.
4. Intellectual property
Unless otherwise specified in a written agreement, copyright and other intellectual property rights in Odelana's original photography, films, designs, website content and other creative work belong to Odelana or their respective rights holders.
Access to a gallery or receipt of a digital file does not automatically transfer copyright.
Where a client has purchased or received photographs or films, the applicable licence or project agreement determines how they may be used.
Unless separately authorised, images and films supplied for personal use must not be sold, commercially licensed, used for advertising or otherwise commercially exploited.
You may share work in ways permitted by your licence and applicable law.
Commercial projects may have different usage rights, permissions and licensing arrangements.
Nothing in these terms overrides a signed agreement governing ownership or use of commissioned work.
5. Client galleries
Odelana may provide galleries through which clients and authorised visitors can view, select, share and download photographs or other media.
Access may be controlled through private links, passwords, accounts or other restrictions.
If you are given access to a private gallery, you are responsible for keeping its access details appropriately secure.
Please obtain permission before forwarding private links or redistributing personal photographs of others.
Gallery owners or commissioning clients may be able to request changes to gallery access, availability or sharing permissions, subject to the relevant project agreement.
We may suspend or remove access where reasonably necessary for security, privacy, lawful requests or service administration.
6. Gallery availability and digital downloads
Gallery availability and downloadable content may vary between projects.
Where an expiry date or access period has been agreed, the gallery may become unavailable after that period.
We recommend downloading and securely backing up your entitled digital files promptly.
Once digital files have been supplied, responsibility for maintaining personal backup copies generally rests with the recipient, subject to any specific contractual obligations we have agreed.
We may change the technical delivery method while continuing to honour applicable contractual and statutory rights.
If a paid digital download is offered, its price, permitted uses and any applicable cancellation arrangements will be made clear before purchase.
7. Photography and film bookings
Photography, filmmaking and other commissioned services may be subject to separate written quotations, booking terms or service agreements.
These may address:
- Project scope and deliverables.
- Dates, locations and schedules.
- Fees, deposits and payment arrangements.
- Cancellation and rescheduling.
- Creative decisions and revisions.
- Delivery dates and formats.
- Usage licences and intellectual property.
- Permissions, releases and publication rights.
Where a separate agreement applies, it governs the relevant project to the extent of any inconsistency with these general website terms.
8. Photographic prints
Where enabled, our gallery service allows customers to purchase physical photographic prints.
Available products, dimensions, finishes, quantities and prices are displayed through the ordering interface.
Print orders are produced using the image files available for the relevant gallery and the specifications selected at checkout.
Customers are responsible for reviewing their selection, print size, quantity, cropping and delivery details before submitting an order.
We may use specialist third-party print laboratories and delivery providers to fulfil orders.
9. Print appearance, colour and cropping
We take reasonable care to prepare photographs for accurate and consistent reproduction.
However, printed photographs may differ slightly from images displayed on screens because of screen brightness, calibration, paper characteristics and the photographic printing process.
Some formats require cropping to fit the selected print dimensions.
The ordering interface may offer cropping previews or controls. Customers should check the final composition before confirming an order.
Important subjects and details should be kept away from trim boundaries wherever possible.
These provisions do not affect your statutory rights if a print is faulty, incorrectly produced or does not conform to its description.
10. Prices and payments
Prices are displayed before checkout, together with applicable delivery charges and any other mandatory costs.
The full amount payable will be shown before you confirm the purchase.
Where enabled, payments may be processed by PayPal or another provider identified during checkout.
Payment processing is also subject to the relevant provider's terms.
An order acknowledgement confirms that we have received an order request. We will communicate acceptance and confirmation of the order through the checkout or order confirmation process.
If we cannot fulfil an accepted order, we will contact you and provide an appropriate remedy, including a refund where required.
11. Print production and delivery
Estimated production and delivery information will be communicated before or during checkout, or in the relevant order confirmation.
Delivery timeframes may vary depending on product specifications, order volume, print laboratory processing and the destination.
Where no alternative delivery period has been agreed, applicable consumer law requires delivery within 30 days unless an exception applies.
If an order is delayed, we will take reasonable steps to provide updates and resolve the issue.
Delivery charges and available locations will be displayed before purchase.
Customers should provide accurate and complete delivery information and contact us promptly if an error is discovered.
Risk in physical goods generally passes to a consumer when they or a person they nominate takes physical possession, subject to applicable law.
12. Print cancellations, returns and refunds
Your statutory consumer rights apply to purchases made through Odelana.
Changes of mind
Some photographic products may be made to a customer's specifications or clearly personalised.
Where the legal exception for genuinely personalised or bespoke goods applies, the usual 14-day change-of-mind cancellation right may not apply.
Where an order does qualify for the statutory cancellation right, customers can exercise that right in accordance with applicable consumer law.
We will make any applicable cancellation restrictions clear before an order is placed.
Faulty, damaged or incorrect products
If you receive prints that are damaged, faulty, incorrectly produced or do not match the agreed description, please contact us as soon as reasonably possible.
Include your order reference, a description of the issue and photographs where helpful.
We will assess the issue and provide the remedy required by applicable consumer law, which may include replacement, refund or another appropriate resolution.
Order errors
If you identify an incorrect image selection, size, crop or delivery address after ordering, contact us promptly.
Changes may be possible before production begins.
We will explain what options are available based on the order's status and your legal rights.
13. Digital content and cancellation rights
Where we sell digital photographs, films or other downloadable content directly to consumers, applicable cancellation rights will be explained before purchase.
If a customer requests immediate digital delivery during the statutory cancellation period, we will obtain any express consent and acknowledgement required by law before treating the cancellation right as lost.
The customer will receive the required confirmation of that agreement.
Free gallery downloads, downloads included in commissioned work and separately contracted services may be subject to different arrangements.
14. Third-party providers
Odelana may use third parties for payment processing, hosting, storage, email delivery, printing and shipping.
These providers support delivery of our services, but their own terms may apply to aspects of their platforms.
We remain responsible for fulfilling our own contractual and statutory obligations to customers.
15. Privacy and personal information
We handle personal information in accordance with our Privacy Policy.
This includes information associated with enquiries, accounts, project delivery, gallery access, transactions and print orders.
Please read our Privacy Policy for further details.
16. Portfolio publication and publicity
Odelana may display selected work on its portfolio, website or social media where it has the necessary rights and lawful basis to do so.
Publication arrangements may also be governed by individual client agreements.
If you have concerns about an identifiable image or recording displayed publicly, please contact us so the matter can be reviewed.
We will consider applicable privacy rights, copyright, contractual terms and other relevant circumstances.
17. Availability and technical issues
We aim to maintain reliable websites, galleries and ordering services.
There may occasionally be interruptions for maintenance, upgrades, technical problems or circumstances outside our reasonable control.
We may make reasonable changes to functionality and infrastructure to improve reliability, security or usability.
We will take appropriate steps to address disruptions affecting paid services and comply with applicable contractual and consumer obligations.
18. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Nothing limits your statutory consumer rights.
For business users, any additional limits of liability may be set out in the applicable written service agreement, subject to law.
We are responsible for losses caused by our breach of contract where those losses are reasonably foreseeable, subject to applicable law.
We do not accept responsibility for losses caused solely by misuse of our services, unauthorised disclosure of private access links by users or circumstances outside our reasonable control, except where the law or our contractual obligations provide otherwise.
19. Complaints and disputes
If you experience a problem with a service, gallery or order, please contact us so we can investigate and seek a fair resolution.
You can contact us at:

Please provide relevant booking or order references where available.
Nothing in these terms prevents you from exercising statutory rights or seeking remedies through an appropriate court or regulatory body.
20. Changes to these terms
We may update these Terms of Use to reflect changes in our services, business operations or applicable law.
Updated terms will be published on our website with a revised date.
Changes will not retrospectively remove contractual or statutory rights relating to purchases or services already agreed.
21. Governing law
These terms are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you retain any applicable mandatory consumer protections and rights to bring proceedings in the courts available to you under relevant law.
Consumers outside the United Kingdom may also benefit from mandatory protections under the laws applicable to them.
